In California-If I have No employees am I still required to carry workman's comp.ins.

We have an employee that injured his back 2 years ago and he went back to work with light duty for 2 weeks and ever since that has been doing his normal job. Now 2 years later we just found out that he made a claim with our Worker's Comp carrier and he is getting a settlement for $36,000. Now if has been working for the past 2 years with no limitations that we were aware of is our Worker's Comp carrier for our company liable for this settlement? Please let me know.
