In extreme cases the failure of an adjudicator to set out the p rocedures and processes could result in the award being unenforceable since the courts have demonstrated in the last six months or so an increased willingness to intervene in cases of procedural irregularity.
The court cases that we heard about in the course of our research indicate that some Band councils are playing an active role in that termination policy by developing and implementing membership codes which reflect the internalized racism of our communities and biological conceptions of identity which are highly constrained.
In such cases it is likely that the courts will enforce the DRB decision pending arbitration unless the court is convinced that the arbitration can commence immediately.
