I was involved in a car accident,60 days later invited to a meeting.I was in the back seat with my 10 year old son,who is MR and has siezers.Alady ran a red light and plowed right into us.We had green light she had red,she was talking and was'nt paying attention.A policeman witnessed the whole thing.My son suffers nopw with nightmares and a fear of the back seat He had a siezer ,i believe during the wreck,and he is still being assessed.At this meetingI was asked how I was doing and I thought I was okay ,alittle sore in the back ,a small dental problem,somewhat of gaps in my memory,maybe just confusion i thought.The adjuster assured me he would give me 500.00 for my inconvience and repair my dental problems.The car we were in was a buick it did'nt roll,just spun 4 times in a 6 lane intersection.The driver was taken to the er,the passenger up front was taken to the er.I picked my son up and carried him across the busy road to a nearby store.It happened in Georgia,I live in alabama.The meeting happened in Troy Alabama,my local office where I have state farm also,My son is special,he already suffers from MR and siezers has since he was 3.I have made no settlement on him.I however agreed to settle mine ,mainly because I needed the money to get him to his doctors.You see I had a van ,the transmissinon went out and the domino effect of this wreck I lost it completely.State Farm is aware of this,so they agreed to give me time to get another vehicle.I asked them to lease me something to see that T.J.,my son to his appointments as they are quite far from home.The adjuster said no because it was not my car that was involved.Now My doctor is treating me for back problems,I have 4 small children,2 with disabilities,T.J.,and Joey who is Autistic with ADHD.I am now resposible for anything that needs to be done for myself.Is this settlement breakable?I have never made a claim in my life ,my driveing record is a good one.The driver of the car we were in is only concerned with his premiums and coverage.The kicker...The driver of the car we were in settled in private over a phone with state Farm,But was at the meeting between the adjuster and myself.I am now not real happy with state farm or the adjuster.Guess who was driving,My sons Grandpa.State farm spent 50.00 a day to provide thre driver with a way to get around,fixed his car,Fixed the other car that was at fault,by the way they are fine.Grandpa won't help take T.J. to doctors,so I have to get help from friends or postpone appointments.As soon as we left the so called meeting,Grandpa the driver of the car thats not even at fault took the 500.00 check from me and claimed he could help me get it cashed.We went through his drive thru window at his bank and he kept it.What can I do,is there anything I can do. |
