We urge the Human Rights Committee to call on the United Kingdom and Hong Kong Governments to take initiatives to ensure that the writ of habeas corpus remains available after 1997 as a means to challenge the validity of detention.

However, the Hong Kong SAR Government has suspended the amending Ordinance and plans to restore the previous legal position, which leaves the private sector free to discriminate on grounds of race as much as it likes.
Moreover, there are also concerns that the Chief Executive or the SAR Government may refer an article of the Basic Law on matters entirely within the limits of Hong Kong's autonomy thereby wholly undermining the autonomy of the SAR.

In the period since the hand-over relief that it was not followed by immediate repression has given way to growing concern that Hong Kong's freedoms will be gradually eroded because of a lack of respect by the Government for the rule of law, and an undemocratic system of Government.
This incident unequivocally demonstrated the SAR Government's willingness to ignore the finality of judgments made by Hong Kong's highest court and to resort to political solutions when displeased by that court's decisions.
In these circumstances the attitude of the Government and of the Electoral Affairs Commission is bizarre, and has done wholly unnecessary damage to Hong Kong's reputation as a free society.
