The company within the transition from one union to the other can start negotiating with the second union from scratch they do not have to start at the place where the other union left off right?

I have a friend who was hired as a Sicilian cook from Italy. She hasn't seen the wage contract , but was hired as a cook,40hr wk.When she got here here duties wasn't as a cook , but a pizza maker. She found another sponsor and is now working as a cook getting the proper wage for that position. She asked for her paycheck from the previous sponsor and he is withholding it because he wants the money it cost him to bring her here. I believe this is a Labour Board matter. Please help this person on what is her rights?
